FLORIDA CHARITY REGISTRATION CHANGES JULY 1

GOOD FLORIDA CHARITY REGISTRATION CHANGES EFFECTIVE 07/01/2024

Please see the newsletter from the Florida Department of Agriculture and Consumer Services highlighting statutory changes to the FL solicitation of charitable contributions effective July 1, 2024: SOC July 2024 Statute change

Below is a recap of the key changes.

FL EXTENSIONS FOR THE FINANCIAL REPORT:

FL extension to file the FL financial report (IRS Form 990) will change from 180 days to matching the approved IRS Form 990 extension due date. This change does not effect the “anniversary” due date of the annual FL solicitation of charitable contributions renewal registration. The extension to file the FL financial report is requested with the annual renewal. The charity must provide a copy of the approved IRS Form 8868 extension request.

FL SMALL CHARITY ANNUAL EXEMPTION THRESHOLD:

The annual exemption for small charities registration requirement has changed.  The FL exemption will now be based on total CONTRIBUTIONS instead of total REVENUE, with the threshold being $50,000.  Be sure and read the FL directions for how contributions are calculated because the FL formula does not exactly follow the Form 990 formula. One more important note, if the charity surpasses the $50,000 threshold at any time during the fiscal year, the charity must complete the full FL solicitation of charitable contributions registration within 30 days.

THANK YOU FLORIDA!
