Don’t Slip Up!

If your nonprofit is not properly registered in states where you are soliciting donations, the implications can be serious.  Understand state charitable solicitation registration requirement for each state so that your nonprofit, its officers, and directors are protected from possible:

• Loss of right to solicit in the state
• Cease and desist orders
• Forced return of charitable donations
• Loss of tax exempt status
• Civil penalties and fines
• Criminal penalties

Registration is not based on an organization’s physical location – it is triggered by where the charity solicits funds.  Of course, there is always an exception!  In California charity registration is triggered by the receipt of assets.
